Terms of Use

These Terms of Use are an electronic record under the Information Technology Act, 2000 and need no physical or digital signature. By requesting, buying or using access to TheForexScalper Pro (TFS Pro), you agree to them. If you do not agree, do not use TFS Pro or this website.

1. Who can use TFS Pro

You must be at least 18 years old and capable of entering a binding contract under the Indian Contract Act, 1872. You must not be barred by any law or regulator from trading or from using trading tools.

2. What you receive

A personal, non-transferable, non-exclusive, time-limited right to use the TFS Pro indicator on your own TradingView account. The PDF guides on this website are free to download and read for your own use. TFS Pro is an invite-only Pine Script that stays on TradingView. You do not receive the source code.

3. Access and payment

• Paid access is not open yet and this website is not selling anything today.
• When paid access opens, TFS Pro will be offered as a monthly subscription, either through TradingView or, if TradingView's terms allow it, through a secure payment gateway on this website. The price, taxes and billing terms will be shown at checkout before you pay.
• Access is added to the TradingView username you give us, is personal to you, and may be ended if you break these Terms or TradingView's rules.
• Pay only through the official checkout. We will never ask you to pay by DM, bank transfer or UPI to a personal account.
• Cancellations and refunds are covered in our Refund and Cancellation Policy.

4. What you may not do

• Share, lend, sell, resell or sublicense your access, your TradingView login.
• Copy, reverse engineer, decompile or try to extract the indicator's code or logic.
• Publish, sell or re-brand our guides, charts or levels as your own, or present TFS Pro output as a paid tips or signal service.
• Use TFS Pro in a way that breaks any law, regulation or TradingView's House Rules and Terms of Use.

5. Intellectual property

The TFS Pro name, logo, indicator, logic, guides, charts and website content are protected by law, including the Copyright Act, 1957. They remain ours. These Terms give you a right to use them as described and no ownership.

6. Third-party platforms

TFS Pro runs on TradingView. Your use of TradingView is under TradingView's own terms. We do not control TradingView's service, data, outages or rule changes, and we are not responsible for them. You need a valid TradingView account to use TFS Pro.

7. No investment advice

TFS Pro is an educational charting tool. We are not a SEBI registered investment adviser or research analyst. Nothing we provide is advice, a recommendation or a tip. Please read our Disclaimer and Risk Disclosure.

8. Your responsibilities

You are responsible for your own trading decisions, results, taxes and legal compliance, including the rules of SEBI, RBI and FEMA that apply to you. Use brokers and platforms that are authorised for you.

9. Suspension and termination

We may suspend or end your access without refund if you break these Terms, share your access, misuse TFS Pro or act unlawfully. You may stop using TFS Pro at any time.

10. No warranty

TFS Pro and the guides are provided as is and as available. We do not promise that they will be error free, uninterrupted, accurate or suitable for any purpose, or that any setup will work.

11. Limits on our liability

To the fullest extent the law allows, TheForexScalper Pro (TFS Pro) and its owner are not liable for any trading loss, loss of profit, loss of business, loss of data, or any indirect, incidental, special or consequential damage arising from your use of, or inability to use, the indicator, this website, the guides or related services.

You accept that trading involves substantial risk and that every trading decision is yours alone, made at your own discretion and risk.

Our total liability for any claim arising from TFS Pro will not exceed the amount you paid for access during the period in which the claim arose.

Nothing in these Terms excludes or limits any right or remedy that cannot lawfully be excluded or limited under applicable law.

12. Indemnity

You agree to compensate us for any claim, loss or cost that results from your breach of these Terms or your unlawful use of TFS Pro.

13. Events beyond our control

We are not responsible for delay or failure caused by events outside our reasonable control, such as outages of TradingView, internet or payment services, natural events, government action or cyber attacks.

14. Governing law and disputes

These Terms are governed by the laws of India. Please write to us first so we can try to resolve any dispute in good faith. If it is not resolved, the courts in India with competent jurisdiction will decide it. Nothing here limits your rights as a consumer under applicable law.

16. Changes

We may update these Terms, the indicator or the guides. The date at the top shows the latest update. Using TFS Pro after an update means you accept it.
